The case is that the complainant purchased a mobile phone from 1st respondent on 16/11/13. The cost of the phone is Rs.22,000/-. Within seven days of the purchase the phone became defective. So approached the 2nd respondent and cured the defect. But it repeated again and cured also. The complainant has lost faith in the product because of repeated defects to the product. So a lawyer notice was issued. But there is no remedy so far. Hence the complaint.
2. The respondents remained exparte.
3. The complainant filed affidavit and Exhibits P1 to P6 series document. There is no evidence to the contrary.
4. In the result the complaint is allowed and the respondents are directed to return Rs.22,000/- (Rupees Twenty two thousand only)and compensation of Rs.5,000/-(Rupees Five thousand only) with costs Rs.1,000/- (Rupees One thousand only) within a month from the date of receipt of copy of this order.
