1. This complaint is filed under section 12 of Consumer Protection Act 1986 and stood over to this date for consideration and this Commission passed the following order.
2. This is a complaint filed by the complainant against the opposite parties alleging deficiency in service on the part of the opposite parties. After admitting the complaint notice was issued to the opposite parties. The notice issued to the opposite parties 1 & 3 served and the opposite parties 1& 3 not appeared before this Commission on the date fixed for their appearance. Hence first and third opposite party called absent and set exparte on 09.01.2020. Second opposite party entered appearance and filed written version denying the allegations raised by the complainant. As the complainant was continuously absent, a notice was issued to the complainant to appear before this Commission to further proceed with this complaint. The said notice issued to the complainant was returned with endorsement “No such addressee”. The above notice was issued to the complainant in the address furnished by the complainant in the complaint. In view of the continuous absence of the complainant, we find that the complainant is not interested to further proceed with this complaint.
In the result, the complaint is dismissed for default. There will be no order as to costs.
A copy of this order as per the statutory requirements be forwarded to the parties free of charge and thereafter the file be consigned to the record room.
