                                                            JUDGMENT

1.                     The facts of the complaint  in brief is that,  the complainant has purchased  one Gionee-P2   Mobile set from O.p. No.1 with a  consideration of Rs.5,500/- on 25.04.2015 vide Cash Memo No.2561   but  to the utter surprise the  mobile set  started giving  trouble and the matter was informed to the O.p No.1  but surprisingly it is informed by the O.p 1 that  there is no service center at Rayagada and refused to replace the same. At last the complainant   finding no other option approached this forum for relief  and prayed  to direct the O.Ps  to   refund the  cost of the mobile set  i.e Rs.5,500/- with compensation of Rs.1000/- .Hence, this complaint.

2.                     On being noticed, neither the O.ps appeared nor filed any written version as such they were set exparte and  in absence of any written version from the opposite party we proceeded  the matter exparte and  believed  the allegations of the complainant  and  hence, we passed the order and  dispose of the matter with the following directions.

                                                              ORDER

                        The  opposite parties  are     directed to  refund the cost of the handset i.e Rs.5,500/-   and pay  compensation of Rs.1000/-  for mental agony undergone by the complainant and cost of Rs.500/-  within one month from the date of receipt of this order, failing which the O.Ps are liable to pay  interest  @  12%  p.a. on the above awarded amount till  the date of payment.

                        Pronounced in open forum today on this 26^th  day of February,2015 under the seal and signature of this forum.

                         A copy of this order as per the statutory requirements , be forwarded to the parties    free of charge.
