Today is fixed for admission hearing of this case. Complainant is personally present. Heard complainant side. Considered submission.

Perused the complaint petition and its annexed documents.

After going through the complaint petition, it appears that the O.ps. have been running their business beyond the jurisdiction of this District Commission. The complainant has pointed out that he has been residing under P.S. Golabari, District – Howrah which is within the jurisdiction of this District Commission but fact remains that no identity prove has been filed by the complainant to prove that he is a resident of Golabari P.S. District – Howrah. In the absence of prove of identity of the complainant, this case cannot be admitted.

Moreover, the complainant has not filed any money receipt to show that he purchase the demo version of the software from the O.ps. In the absence of money receipt, there is no prove that the complainant has purchase the goods. So, it cannot be said that complainant is a consumer under the O.ps.

It is also important to note that this District Commission after close compare of the complaint petition with the annexed documents finds that the case adopted by the complainant is self contradictory.

Considering all the above noted factors this District Commission is of the view that this complaint case cannot be admitted and so it is dismissed and disposed off. No order is passed as to cost.
