Sh. Amit Agarwal, learned counsel for the appellant and Sh. Shree Gopal Narsan, learned counsel for respondent, are present through video conferencing.

An application has been moved on behalf of the appellant, stating that the impugned judgment and order dated 02.11.2016 passed by learned District Commission has been complied with by the appellant and decretal amount has been paid by the appellant to the respondent – complainant, hence the appellant does not want to press this appeal.

Learned counsel for respondent also admits that decretal amount has been received by the respondent – complainant.

Accordingly, this appeal is dismissed, as not pressed.

The amount deposited by the appellant with this Commission, be released in its favour.
