ORDER:-

1.       Both counsels are present.  The Official of RA Petitioners 1 and 2 are present.

2.       Heard on the RA Petition.  This Commission ordered to dismiss the appeal on 28.12.2023   for default & non-prosecution and directed the Office to transfer the deposited amount to the District Commission.   In the meantime, Appellants in Appeal No.2600/2016, came up with this RA to review the order dated 28.12.2023.  Anyhow, the Appellants/RA Petitioners have filed this RA showing their interest to prosecute Appeal No. 2600/2016, which could be considered by the Commission to restore the appeal in order to decide the case on merits in accordance with law. In consideration of the active participation of the respondent in the appeal, in our view, it would be just and proper to impose cost of Rs.5,000/- payable to Respondent.  Accordingly, the order dated 28.12.2023 stands reviewed and Appeal No. 2600/2016 stands restored to the file of Commission.  The Registry is directed to list the appeal case before the commission to hear arguments by 22.10.2024.

3.       Send a copy of this Order to the District Commission and the parties concerned.
