Ld. Advocate for the opposite party/petitioner submits that the document (Annexure - C) to the complaint application is an unregistered agreement for sale.

The said agreement for sale has been executed on a stamp paper valued at Rs. 10/-. So the document may be impounded.

Ld. Advocate for the complainant raised objection and states that the application is pre-matured and cannot be allowed at this stage.

It is fact that the agreement for sale filed by the complainant at the time of filing of Complaint Case is an unregistered and insufficiently stamped document. Till date evidence of the complainant has not been started. Complainant has not tendered the aforementioned document in her evidence.

Therefore, we are of the opinion, the Misc. Application has been filed pre-maturely and cannot be allowed at this stage.

Therefore, the Misc. Application dated 27.03.2023 stands dismissed on contest but without cost.
