Smt. Anamika Nanda, Member : - The complainant purchased one Onida LED, LEO TV by paying Rs.21,000/- only on dtd. 25.09.2015 from one Sahej Square, Rourkela with warranty period of one year i.e 25.09.2016. The said TV set started occurring problem from dtd. 12.05.2017 about which the complainant lodged complaint to the O.Ps. on 13.05.2017. The mechanic of the O.Ps came to the house of complainant and took the power unit of said TV on dt. 31.05.2017 and assured to return the same after repairing or new power unit. The complainant contacted several times with the O.Ps but no response. The complainant purchased a new Samsung LED TV on dtd. 20.08.2017 and on dtd. 21.08.2017 he received a phone call from the O.P No.2 stating that since new power unit will take time to arrive, company is ready to give 25% discount on MRP in purchase of new Onida LED TV. Hence this case.

After being noticed the O.P.1 & 2 appeared through their authorized representative and filed written statement but the O.P NO.3 failed to appear and stand ex-parte.

The O.Ps submitted that, the complainant have never lodged any complaint to the O.Ps and there is no any job-sheet / service details report and denies all the allegations of the complainant and prayed on dismissal of the case.

The complainant filed a copy of e.mail sent by Onida Website dtd.28.06.2017. It means the complainant had rightly contacted with the O.Ps but the O.Ps did not responded. The authorized representative of the O.P.No.1&2 orally submitted that though the complainant has purchased a new TV they will provide discount @25% on the next anything purchasing of Onida brand.

On the above observation we are in considered opinion to allow party the complaint case directing the O.Ps to provide @25% discount on first next purchasing only on any product of Onida brand by the complainant.  

Accordingly the present case is disposed of.

Order pronounced in the open court today on this the 21^st day of December’ 2017. Free copy of this order shall be communicated to the parties as per Rule.
