ORDER

Per Mr.P.N.Kashalkar, Hon’ble Presiding Judicial Member

There is delay of two years six months and eleven days in filing this appeal.  Delay is not properly explained by the appellant. In the forum below appellant remained ex-parte and this is the usual method of builders of remaining absent in the trial court and then filing appeal only after they receive notice of execution.  In the instant case also respondent had filed execution proceedings for recovery of `2,33,000/- as per award and when he received notice, builder/appellant filed this appeal so belatedly.  So delay of two years six months and eleven days is not properly explained.  No sufficient cause has been made out and, therefore, we are not inclined to allow condonation of delay application.  Hence the following order:-

                                      ORDER

Misc.application no.10/146 for condonation of delay stands rejected.           

Appeal therefore does not survive for consideration.

Copies of the order be furnished to the parties.
