This revision petition has been filed by the revision petitioner/Opposite Party No.2, against order dated 08.05.2017 passed by District Consumer Disputes Redressal Forum-II, UT, Chandigarh (in short “the Forum” only) ordering exparte proceedings against the revision petitioner for not putting in appearance.
2. It is stated by Counsel for the revision petitioner that non appearance was not intentional. It is further undertaken by Counsel for the revision petitioner that reply and evidence/affidavit will be placed on record within two weeks from today.
3. At the time of hearing, Sh.Ranjai Sanadi, father of respondent No.1/complainant has appeared in person. He has shown his grace by not opposing the prayer made by Counsel for the revision petitioner.
4. In view of above, this revision petition is allowed. Order, under challenge, is set aside to the extent ordering exparte proceeding against the revision petitioner/Opposite Party No.2.
5. Parties are directed to appear before the Forum on the date fixed before the Forum i.e. 14.08.2017.
6. In the meantime, as per undertaking given, the revision petitioner/Opposite Party No.2 will place its reply and evidence/affidavit within two weeks from today before the Forum, failing which, no further opportunity shall be granted. We expect and hope that the Forum will make an attempt to decide the matter, on merits, expeditiously.
7. Order passed is subject to payment of Rs.2500/- as cost. The said amount shall be paid by the Revision Petitioner/Opposite Party No.2 to respondent No.1/ complainant on the next date fixed before the Forum.
8. Certified copies of this order be sent to the parties, free of charge.
9. Complete record alongwith a certified copy of this order be sent to the Forum, immediately, so as to reach there before the date fixed.
10. File be consigned to the Record Room after completion.
