   The facts of the complaint in brief are as follows:

   That the complainant had purchased a mobile phone set for an amount of Rs.13,500/- on 9/12/14 having a warranty of one year.  After six months of its purchase the  mobile phone has got a complaint and  the same was informed to the opposite parties.  Complainant was waiting for 75 days.  But  the opposite party failed to repair the mobile phone.  According to the complainant the market value of the  mobile set is for Rs.30,000/-.  The delay in repair  caused mental agony to the complainant.  Hence the complaint is filed for necessary redressal.

   On admission of the complaint the Forum issued notice to both opposite parties.  Ist opposite party sent notice but not turned up.  Name of the Ist opposite party called absent and set exparte.  Notice to 2^nd opposite party neither  served nor returned.  It is presumed under Sec.28 (A) of the C.P.Act that the party duly served the notice and  the name of 2^nd opposite party also called and set exparte.

       Complainant examined as PW1 and Ext.A1 & A2 were  marked.  Heard the complaint and documents perused.

       Here the opposite party failed to provide after sale service to the customer.  Denial of after sale service amounts to deficiency in service.  There is no contra evidence before the Forum.

       Therefore the complaint is allowed and opposite parties are jointly and severally  directed to pay  Rs.13,500/- the price  of the mobile phone set and  further  directed to pay Rs.3000/- towards cost of the proceedings to the complainant.  Time for compliance is limited to 30 days from the date of receipt of copy of the order.
