CONSUMER COMPLAINT NO.  34 OF  2016

Munish Vs Micromax Informatics and Ors.

PRESENT:

                   Sh. Amandeep Singh, counsel for the OP-1

ORDER

                   Sh. Amandeep Singh, counsel for the OP-1  has made the following statement, recorded separately: -

                        “The OP-1 offers to pay Rs.15500/- (Rs.12500/- as invoice price plus Rs.3000/- as cost of litigation) to the complainant in full and final settlement of the dispute.  The amount will be paid within 45 days from today”.

                        Sh. Gaurav Bhardwaj, counsel for the complainant has made the following statement, recorded separately: -         

                        “I accept the offer.  The defective mobile handset is with the service centre (OP No.2).  I withdraw this complaint. Complainant will handover accessories to counsel for OP No.1 at the time of receiving the payment”.

                        In view of the compromise arrived at between the parties, it is ordered that OP-1 shall pay a sum of Rs.15500/- to the complainants in full & final settlement of the dispute within 45 days from today, failing which the   OP-1 shall pay the above said amount along with interest @18% p.a. from the date of filing of the complaint till the date of realization. Parties shall be bound by the statements made before this Forum. 

                        Certified copy of this order be communicated to the parties free of cost. After compliance file be consigned.
