The complainant purchased a mobile hand set from Chennai at a price of Rs. 9,900/-. According to the complainant time and again he had to approach 2^nd opposite party to get the defects of the gadget rectified. It is stated that the opposite party could not rectify the defects due to its inherent manufacturing defect. Therefore he is entitled to get refund of the price of the hand set. The records and documents produced would show that the case of the complainant is genuine. Accordingly we allow the complaint in part and direct that the opposite parties to refund Rs. 9,900/- to the complainant with 12% interest p.a. till realization together with

Rs. 1,000/- towards costs of proceedings. Opposite parties shall comply with the above order within 30 days from today.
