2.11.2015 Present: Counsel for complainant.

Sh. V.S. Duggal Counsel for O.P-1, however the O.Ps-1 & 2 are already exparte.

Sh. V.S. Duggal Advocate appeared on behalf of opposite party No. 1. Statement of the Ld. Counsel for opposite party No. 1 recorded to this effect that the opposite party No. 1 is ready to replace the Mobile in question of the complainant and in case the said Mobile of the same model is not available then the Company (opposite party No. 1) will make the payment of the price of the Mobile in question within 30 days.

On the other hand the statement of the Ld. Counsel for complainant recorded to this effect that he has heard the statement of the Ld. Counsel for the opposite party No. 1 and he accepted the same and order be passed accordingly.

In view of the statement of the Ld. Counsel for the parties, the Company (the opposite party No. 1) is directed to replace the Mobile in question of the complainant and in case the Mobile of the same model is not available then the Company (the opposite party No. 1) is directed to make the payment of the Mobile in question within 30 days. In case the Company (the opposite party No. 1) fails to comply with the order within 30 days then the complainant is at liberty to move this Forum for compliance of the order and the complainant is also entitled interest @ 12% per annum till realization. Accordingly, this complaint is disposed of. Copy of the order be supplied to the parties free of costs. File be consigned to records.
