Learned counsel of the opposite party no. 1 submits an application stating therein that both the parties has agreed to compromise the case and as such he has prayed that the date fixed in the instant case i.e. 09.07.2015 be prepone for today and final order may be passed. Learned counsel of the complainant has got no objection. Heard both the parties and perused the record and accordingly we prepone the date already fixed i.e. 09.07.2015 for today. Member (F) Member Mr. R.C. Narayan Advocate appears on behalf of the opposite party no. 1. Learned counsel for the complainant is also present. It is submitted by learned counsel of both the parties that they have agreed to make a compromise in the case. Mr. R.C. Narayan submits that the company is ready to refund the price of Mobile Set and also ready to make some payment to the complainant towards compensation and litigation cost and the cost may be decided by the forum itself. Learned counsel of the complainant has got no objection and he submits that Mobile Set is presently with the Service Centre. Accordingly We direct the opposite party no. 1 to refund Rs. 2,000/- ( Rupees Two Thousand only ) being the price of the Mobile Set to the complainant within two months from the date of receipt of this order provided the complainant also returns back the accessories of the Mobile Set to the opposite parties. Aforesaid opposite party is further directed to pay Rs. 1,000/- ( One thousand only ) as composite charge for compensation and litigation cost. Thus, this complaint case stands disposed of.
