Ops.2 and 3 duly served, but not present in spite of the fact that the complaint was called several times, hence proceeded against exparte.

                At this stage, Shri Sagar Sharma, Adv., for OP.1 i.e. Micromax House has stated that the matter stands compromised with the complainant. As per compromise, the opposite party No.1 is ready to make payment of Rupees 7500/- to the complainant within 45 days from the date of receipt of certified copy of this order subject to deposit of Battery, Charger, Ear phones and phone case box  with the opposite party No.2 i.e. M/s Keshav Communications. The said fact  is admitted to be correct by the learned counsel for the complainant. Statements to this effect recorded and placed on file.

                In view of the compromise between the complainant and the opposite party No.1, the opposite party No.1 is directed to pay Rupees 7500/-  to the complainant within 45 days  from the receipt of copy of this order subject to deposit of Battery, Charger, Earphone and case box of the mobile phone with the opposite party No.2 against receipt. In case the opposite party No.1  fails to make payment  of the said amount within 45 days, the said amount shall bear interest  at the rate of 9% per annum from the date of filing of the complaint i.e. 31-08-2015 till the said amount is paid  or realised and also bear cost of the complaint amounting to Rupees 5,000/-. The complaint stands disposed of accordingly. Let certified copy of this order be issued to both the parties free of cost.
