This C.C having been heard on 11..01..2017, the Forum on 16..03..2017 delivered the following:
ORDER

Complainant is one Karthi. V.K from Palghat. Through online she booked a Micromax Unite 2 A 106 mobile handset on 23/12/2014 for an amount of Rs. 6195/-. She received the handset on 26/12/2014. Within 2 weeks of its purchase, when she tried to insert the 2nd sim, she found that there was some defect with it. So she entrusted the set with the 2nd opposite party for repair. They told her to wait for 20 days to get it rectified. After 2 months when she went there they gave her a set and told that the defect was cured. Since the defect was only with the sim slot, she checked that only. But when she verified the set in detail, she found that there are so many defects in that set and it was a set of 4GB memory. Again she approached 2nd opposite party with that set and they were not even ready to receive that hand set back. They told her that they will inform this to the 1st opposite party and when they receive the replaced set from there, they will inform her. But nothing happened. So she approached this Forum claiming relief.
2. Opposite parties were set exparte.
Complainant filed affidavit along with documents which includes the retail tax invoice for Rs. 6,195/-. Nothing is brought in evidence against the contentions raised by the complaint. So we are allowing the complaint. The purpose for which she purchased the hand set was not served, for which the complainant is eligible for compensation which we fix as Rs. 2500/-. Considering the facts and circumstances of the case, no order on cost.
In the result, complaint is allowed. Opposite parties are jointly and severally ordered to refund the complainant Rs. 6,195/- along with Rs. 2500/- as compensation within 2 months of receipt of this order failing which Rs. 8,695/- (Rs. 6195 + 2500/-) will carry interest at the rate of 12% till the date of realization. No order on cost.
A copy of this order as per the statutory requirements be forwarded to the parties free of charge and thereafter the file be consigned to the record room.
