ORDER

     Sh.Amandeep Singh, Counsel for OP/JD has brought a post dated cheque for Rs.13,000/- and made an endorsement on the first page of the execution application itself that total amount due was Rs.13440/-, however, Rs.440/- has been deducted as the complainant has not returned accessories of the handset in question. He has handed over a post dated cheque bearing No.119955 dated 06.11.2017 for Rs.13,000/- to Sh.Shobit Phutela, Counsel for Complainant/DH, who recorded his statement in the shape of endorsement on the first page of the execution application itself withdrawing the instant execution application subject to clearance of the cheque. Photocopy of cheque has been taken on record.  Consequently, instant execution application is dismissed as withdrawn subject to realization of cheque. Warrants, if any sent in this case be called back unexecuted forthwith.

     Certified copies of this order be sent to the parties free of cost. The file be consigned.
