The record is taken up for admission hearing and order.

The complainant has filed this case stating that he has given his Micromax Mobile Phone in the service centre for servicing with payment of Rs.2,060/- and he took back the phone after taking the service but not working as previous means. He know the matter to the concerned authority repeatedly along with an Advocate’s letter but no result. For this he has lodged this complaint before this Commission. On perusal of the record it is found that no document has been filed in respect of the mobile phone in question and no documents to show that he has paid Rs.2,060/- to the O.P as servicing charge for the mobile. On the contrary, one cash memo which is not in proper form has been filed which disclosed that something was sold to the complainant. Therefore, there is no question of service of the mobile phone at all.

Under the above circumstances, we find no prima facie case for admission of the same.
