Janak Sharma      Vs.    MI Services Centre.

 

Present:           Complainant in person.

                        Opponent No.1 ex-parte.

                        Sh. Jasbir Singh Rana, Adv. for the opponent No.2.

                        Sh. SS Saini, Adv. for the opponent No.3.

                        (Notice of the complaint was not ordered against opponent No.4).   

                         

                  On the basis of even dated application filed by the complainant, file taken up on today. In order to prove his identify, the complainant has shown his Aadhar Card. Photocopy of the same retained on record. The complainant and counsel for the opponent No.2 have entered into amicable settlement and Sh. Jasbir Singh Rana, Adv. on behalf of the opponent No.2, offered fill and final payment in the sum of Rs.13,528/- to the complainant, within the period of 45 days from today and the complainant has returned the mobile, charger and mobile box. The offer made by the opponent No.2 is accepted by the complainant. Statement of counsel for the opponent No.2 and the complainant recorded.

                     Keeping in view the statement made by the counsel for the opponent No.2 and the complainant, without passing any adverse comment on the act and conduct of any of the parties, matter being amicably settled between the parties, the complaint is, accepted, against the opponent No.2, holding it liable to make payment of Rs.13,528/- (Rupees Thirteen Thousand Five Hundred Twenty Eight only), to the complainant, as full and final settlement of the matter, within the period of 45 days from the date of order, in default of it, the opponent No.2 shall liable to make payment of simple interest @8% per annum from the date of order till actual payment. Complaint qua opponent No.1 and 3 is dismissed. The Reader of this Commission is directed to record the necessary entry in the relevant register or computer, showing the final disposal of the complaint on today instead of 30.07.2024. Certified copy of this order be supplied to the parties free of costs. File be consigned to records.
