Sandeep Kumar son of Sh. Chand Singh, resident of Badoli Tehsil Unn, District Shamli (UP) now resident of House No.160, Sector-5, Urban Estate, Karnal.

  1. Metro Motors, near Baldi Byepass chowk, Karnal-132001, through its authorized signatory.
  2. Tata Motors Limited, NVB-Servo-Lucknow-226019 through its authorized signatory/representative.
  3. Tata Motors Bombay House No.24, Homi Mody street Mumbai-400001, through its authorized signatory.

Complaint under Section 35 of Consumer Protection Act, 2019.

Present: Sh. Balwan Singh Kashyap, counsel for the complainant.

                             

       Today the case is fixed for consideration on the point of admissibility.

                 Learned counsel for the complainant has suffered his separate statement to effect that due to commercial vehicle’s, this Commission has no jurisdiction to entertain and try the present complaint, so he does not want to pursue with the present complaint further and withdraws the same with permission to file the fresh complaint on the same cause of action before the competent Court of law.      

              In view of the above statement the present complaint is dismissed as withdrawn. However, the complainant is at liberty to file fresh complaint on the same cause of action before the competent Court of law, if so desired. The original documents annexed with the complaint, if any, be returned to the complainant by placing on record photocopies of the same. Parties concerned be communicated of the order accordingly and file be consigned to the record room.
