Case is called out.

Today none has appeared on behalf of the complainant inspite of several calls, whereas learned counsel                            Sh. T.S. Bindra for the opposite parties has appeared.

A perusal of the record has shown that a court notice was sent to the complainant and as per track report (paper      No. 86) the said court notice was duly served upon the complainant. Thus, the service of court notice upon the complainant is considered as sufficient.

Inspite of the service of court notice neither the complainant has appeared nor the complainant’s counsel has put his apperance before this Commission.

It appears that the complainant is not ready to contest this complaint, hence in such circumstances, the consumer complaint should be dismissed.

Accordingly, the consumer complaint is dismissed.  No order as to costs.

File be consigned to the record room alongwith copy of this order.
