Brief facts of the case are that the complainant, who is the consumer of the OP MeSEB stated in her complaint that till the month of December 2008 her electricity bill amount never exceeded Rs 1000. The bill for the month of March 2009 amounted to Rs 5,252. The bills for the month of January and February 2009 were not supplied to the complainant. Thereafter complainant received the bill dated 9.4.2009 for an amount of Rs 10,228, bill dated 11.5.2009 for Rs 5,482, bill dated 9.6.2009 for Rs 6,601 which were exorbitantly high. In spite being aggrieved by the exorbitant amount of the bills, the complainant made the due payment to the OP. During the month of February 2009 the OP deputed a person to check the meter and the same was found defective and replacement of the same was made. However the bills continued to be exorbitantly high. Complainant thereafter brought to the notice of the OP regarding the continuance of the high billing in spite of the meter being changed but no steps was initiated by the OP to rectify the same. Since, no explanation regarding the high billing from the OP, complainant therefore did not pay the bills dated 9.4.2009, 11.5.2009 and 9.6.2009 and preferred this complaint before this Forum, hence this case. Notice was issued to the OP who also filed the show cause. In their reply they have stated that the average consumption of electricity by the Complainant during winter months exceeds Rs 1000. OP denied that complainant did not receive the bills for the month of December 2008 and January 2009. OP submitted that the complainant received the bills on or before 30.01.2009 and accordingly she was advised testing of meter for confirming the correctness of the meter. The meter was tested on 29.1.2009 and was found defective. Accordingly the bills for the said months were prepared on average consumption. Thereafter replacing the meter the bill for the period w.e.f from accounting month December 2008 up to the accounting month April 2009 has been on the average consumption at 255per units per month of the proceeding 6 months before the meter became defective except for the accounting month of may 2009 in which the amount of bill was prepared as per consumption of electricity recorded in the new meter. On the basis of the materials on record and submissions made by the parties, this Forum makes the following observations 1. The average consumption for the winter months was higher than the summer months and which came to around 565 units. However the average consumption during the summer months was less. 2. There was a fault in the meter which was accordingly replaced in the month of April 2009. 3. From the month of May 2009 onwards the billing was done as per the reading of the new meter. On the basis of the above observations we direct the OP to re assess the bill from the month of December 2008 to May 2009 on the basis of average consumption by the consumer to the corresponding period of the previous years and re-adjust the excessive amount, if any, to the present bill to be paid by the consumer. The OP is directed to do this re-assessment and re-adjustment within 30 days from the date of receipt of this order. Case disposed off.
