Today is fixed for showing cause by the complainant.

No step taken by the complainant. None is present on behalf of the complainant. OP files hazira through the ld. Advocate.

It is found from the record that the case is conducting by the complainant in person. It is evident from the order No. 08, dated 01.02.2018 that this record was fixed for filing questionnaire by the Ops. Though the Ops have filed their questionnaire with copy, but the copy could not be served as the complainant was found absent and taken no step on that date. So the case record was fixed on 23.02.2018 for filing reply of questionnaire by the complainant and the complainant was directed to receive the copy of the questionnaire in the meantime.

            On 23.02.2018 it is found from record that the complainant was absent and no step taken by the complainant, though the OP was present by filing hazira.  So the complainant was directed to show cause as to why the case shall not be dismissed for default due to non-prosecution.

Today the complainant is also found absent on call and no step taken by the complainant. No show cause has been filed by the complainant. The OP is found present by filing hazira.

As the complainant is found absent on three consecutive dates and no reply is filed by the complainant of showing cause, so it is very much clear that the complainant has lost his interest to proceed with this complaint.

Hence, it is

O r d e r e d

that the Consumer Complaint being No. 193/2017 be and the same is dismissed for default  due to non-prosecution without any cost.

            Let plain copies of this order be supplied to the parties free of cost.
