Today is fixed for filing W/V by both the OPs and vokalatnama by the OP No.2.

OP No.2 filed vokalatnama along with a petition for time to file W/V. Complainant files hazira through Ld. Advocate. Both the complainant and the OP No.1 have filed a joint petition with verification, stating that the case has finally been amicably settled out of Court on the terms and conditions that the OP No.1 will pay Rs.76,066/- (Seventy six thousand sixty six) only to the complainant and the complainant will hand over the vehicle along with accessories and documents to the OP No.1 as well as withdraw the present pending case with full satisfaction. As per terms of settlement, the complainant is not willing to proceed with the present case further and prayed for disposing of the case for non-prosecution.

Heard both sides in full. Perused the case record. Considered. On the above terms and conditions, the complainant prayed for disposing of the case on the ground of non-prosecution and there is no obstruction to pass an appropriate order.

Hence, it is ordered that this case be and the same is dismissed for non-prosecution.
