ORDER

Learned counsel for the petitioners submitted that draft of Rs.2500/- has been given to the respondent/complainant as per order dated 09.03.2012. Heard learned counsel for the parties. Learned State Commission dismissed the appeal of the petitioners vide impugned order dated 10.01.2012 in default and in the presence of the respondent along with her counsel. Learned counsel for the petitioners submitted that though the petitioner representative was present in the court but he could not appear when the case was called and as such, appeal was dismissed in default in the presence of the respondent, so the petition may be accepted and the matter may be remanded back to the State Commission for disposal on merits. Respondent also has no objection in accepting the petition subject to cost. Consequently, the petition is accepted and order of the learned State Commission dated 10.01.2012 passed in F.A. No.308/2008 is set aside subject to payment of Rs.5,000/- as cost to the respondent and matter is remanded back to the State Commission for disposing the appeal on merits after giving opportunity of being heard to both the parties. Parties are directed to appear before the State Commission on 30.10.2012.
