student becomes disinterested and fails to join the <br /> classes in the Institute due to any reason whatsoever<br /> and wants to take his/her money back, the Institute <br /> will not refund the money deposited. The course fee <br /> towards the particular course will not be adjusted <br /> towards any other course."<br /> Complainant has not rebutted the affidavit Ex.RA of GurjitPal Walia that complainant's son availed of coaching services from April, 2006 to Oct.2006. No doubt it has been alleged in para-4 of the complaint that within few days of joining the course, , son of the complainant observed that teaching staff was not so competent and qualified to impart education in the prescribed courses and that no special attention was given to him , no weekly test was taken, no study material was provided to any student and that he had failed in June,2006. Surprisingly he has not proved any protest letter or representation or complaint to the Institute of opposite party to highlight his grievances on account of unsatisfactory performance of teaching staff and their incompetency for teaching but on the other hand he continued receiving teaching of the course uptil Oct.2006. On the other hand he failed to deposit arrears of Rs.4000/- and subsequent amount of Rs.12000/- after August,2006. Opposite party has produced prospectus highlighting teaching staff in various streams and also certificates and testimonials of some of the teachers vide Ex.R3 to R13.. Opposite party has also filed affidavits Ex.R15 of Neeraj and R16 of Ranvir Kumar that they obtained coaching for 100 days three hours daily class with full satisfaction from qu8alified and expert staff. Therefore, we are of the considered opinion that allegation of incompetent and unexperienced staff has been levelled by the complainant to avoid his liability to pay balance of coaching fee for one year course and left Institution of opposite party in Oct.2006. Thus opposite party cannot be held deficient in coaching services.<br /> 8. Apropos the territorial jurisdiction of this Forum, this fact is proved that opposite party MEDITECH has one of its branch office at Phagwara though opposite party has corporate offie at Chandigarh road, Ludhiana, so part of cause of action has definitely arisen within territorial jurisdiction of Kapurthala.<br /> In the ultimate analysis of aforesaid discussion, finding no merit in the complaint, same is hereby dismissed with no order as to costs. <br /> Let certified copies of judgment rendered be supplied/despatched to the parties without any unnecessary delay and thereafter file be consigned to record room,.<br /> <br /> Announced : ( Gulshan Prashar ) ( Shashi Narang ) ( A.K.
