Final Order / Judgement

Order No. 2                          22/11/2022

The case is taken up for admission hearing.

Ld. Advocate for the complainant is present.

Perused and considered the petition of complaint and the photo copy of the document annexed thereto in detail.

It is apparent on the face of the record that the case is barred by limitation.

Moreover, no document has been submitted by the complainant to prima facie prove that the opposite parties were negligent in the treatment of Late Satinath Ghosh, husband of the complainant. On the other hand it appears from the documents submitted that Late Satinath Ghosh was given treatment by both the Government Hospitals. He was detected with Stage-4 Carcinoma and subsequently it spread in his brain. All the medical papers of  Government Hospitals do not show any delay in treatment of deceased Satinath Ghosh.

In view of the above discussion, the instant case cannot be admitted.

Hence, it is

                                                                        O R D E R E D

that the complaint case be and the same is dismissed without cost.
