Complainant  is    present   with  ld. counsel and    heard   the  ld.  counsel   on the   point  of  admissibility  of the  complaint.  In the complaint   petition   at   para  7   the    complainant   had    made   a    prayer   for   refund  of    Rs.47,09103.70   being   part   of  CGHS   payment  along with    complainant’s  own payment   of  hospital  bill  and  a    damage   of Rs.9 crore  for  medical  negligence  &    deficiency  of  service   &  a   compensation  of   Rs.52,90,806.30   for causing   mental   agony  &   physical harassment   etc.    and   the  total    value  of  the   complaint  is  assessed  at  Rs.10,00,00000( ten crores) and   court  fee   for  Rs.800/-  is  paid   by draft  is   payable   under   section-35 of the   Consumer  Protection Act, 2019.

We   have  considered  notification  issued  by   National  Consumer  Disputes Redressal   Commission, Govt  of India  notification   no- A-2/Listing /NCRDC / 2021  dtd. 7/2/2022.  The  jurisdiction   of this      commission   to   entertain   complaint where   the  value  of  goods &   service   paid   as   does   not  exceed   Rs.50,00,000/- .  In the    present   case  in hand  the  value  of  service  paid  appears  beyond  the   limit  of   jurisdiction  as   mentioned   above.

Hence   , petition  is  not   admitted  for want  of   jurisdiction  &    complainant  is  at  liberty   to  place   his    grievances     before  the   appropriate  commission.
