1.       This complaint is filed under section 12 of Consumer Protection Act 1986 and stood over to this date for consideration and this Commission passed the following order.

2.       This is a complaint filed by the complainant against the opposite party alleging deficiency in service on the part of the opposite party. After admitting the complaint the notice was issued to the opposite party. The opposite party entered appearance and filed version denying the allegation of deficiency in service raised by the complainant. Since 16.01.2020 this case is adjourned for the affidavit of the complainant. Since then the complainant is continuously absent. Inspite of informing the complainant over phone more than once from the office of this Commission, the complainant failed to appear before this Commission. The complainant has not filed any affidavit or marked any document to prove the case put forward by the complainant against the opposite party. As such there is no evidence to substantiate the allegations raised against the opposite party. In view of the continuous absence of the complainant and in action on the part of the complainant to file affidavit or documents to prove his case, we find that the complainant is not interested to further proceed with this complaint.

          In the result, the complaint is dismissed for default. There will be no order as to costs.

  A copy of this order as per the statutory requirements be forwarded to the parties free of charge and thereafter the file be consigned to the record room.
