This is a complaint filed under section 12 of Consumer Protection Act 1986 and the matter stood over to this date for consideration.After hearing the matter the commission passed an order as follows:
This is a complaint filed by the complainant against the opposite parties alleging deficiency in service on the part of the opposite parties. After admitting the complaint notice was issued to the opposite parties. Though the 1st opposite party accepted the notice, failed to appear before this Commission and hence 1st opposite party was declared ex parte on 28/11/2019. The 2nd opposite party appeared in person and sought time for filing version. Inspite of giving sufficient opportunity, the 2nd opposite party fail to file version and hence on 10/02/2020 the 2nd opposite party was called absent and delcared ex parte and this case was posted for affidavit of the complainant. When the case came up for consideration today, it is noticed that the complainant is continuously absent and hence this Commission has issued a notice to the complainant to appear before this Commission on 19/02/2022. Even after accepting the notice, the complainant failed to appear before this Commission to proceed with this complaint. As the complainant was continuously absent and not filed an affidavit or marked any documents to substantiate his case, we find that the complainant is not interested to further proceed with this complaint.
In the result the complaint is dismissed. There will be no order as to cost.
A copy of this order as per the statutory requirements be forwarded to the parties free of charge and thereafter the file be consigned to the record room.
