This is a complaint filed under section 35 of Consumer Protection Act 2019 and the matter stood over to this date for consideration.After hearing the matter the commission passed an order as follows:
This is a complaint filed by the complainant against the opposite parties alleging deficiency in service on the part of the opposite parties. After admitting the complaint notice was issued to the opposite parties. After accepting the notice 2nd opposite party failed to appear before this Commission and hence on 17/12/2021 the 2nd opposite party called absent and set ex parte. The 1st & 3rd opposite parties filed written version denying the allegation raised by the complainant against the opposite parties. On 09/02/2024, when the case came up for consideration, the counsel appearing for the complainant filed a memo stating that he is relinquishing the vakalath of the complainant and reported no instruction. Hence this Commission issued a notice to the complainant to appear before this Commission today to further proceed with this complaint. When the case came up for consideration today, it is found that the notice issued to the complainant was seen returned with endorsement “unclaimed”. In spite of giving sufficient opportunities, the complainant failed to appear before this Commission and adduce any evidence to substantiate his case against the opposite parties. In the absence of any piece of evidence from the side of the complainant against the opposite parties, we find that the complainant has miserably failed to establish his case put forward against the opposite parties. In the above circumstances we find that this is fit case to be dismissed for want of evidence.
In the result complaint is dismissed. There will be no order as to cost.
A copy of this order as per the statutory requirements be forwarded to the parties free of charge and thereafter the file be consigned to the record room.
