            The case of the complainant in short is that complainant had mediclaim being MIN No.5303472 and was under insurance cover of o.p. and complainant was admitted in Kothari Medical Centre, Kolkata for her treatment under Dr. S. Pattnaik on 27.9.10 and was discharged on 28.9.10 and complainant had to incur a sum of Rs.12,765/-. Hence the case was filed by complainant with the prayer contained in the petition of complaint.

                Sole o.p. did not contest this case by filing w/v and matter was heard ex parte against the o.p.

Decision with reasons:

                We have gone through the pleadings of the complainant, evidence and documents in particular and we find no mediclaim policy attached with the petition of complaint nor any claim preferred by complainant with o.p. and sole o.p. is TPA and we find no material on record to consider and allow the prayer of the complainant for want of documents consisted with the petition of complaint. Besides, in the petition of complaint there is no whisper as regards submission of claim with the o.p.

                In view of the findings above and on perusal of the entire materials on record we hold that the complainant has miserably failed to substantiate and prove her case as has been alleged in the petition of complaint and complainant is not entitled to relief.

                In result, the case failes.

                Hence, ordered,

                That the case is dismissed ex parte without cost against the o.p.

                Supply certified copy of this order to the parties free of cost.
