This is a complaint filed under section 35 of Consumer Protection Act 2019 and the matter stood over to this date for consideration.After hearing the matter the commission passed an order as follows:
This is a complaint filed by the complainant against the opposite party alleging deficiency in service on the part of the opposite party. After admitting the complaint, notice was issued to the opposite party. The notice issued to the opposite party was returned with endorsement ‘left’ and hence this Commission directed to complainant to take steps. When the case came up for consideration today, it is noticed that the complainant is continuously absent. The notice was also issued to the complainant to appear before this Commission today to further proceed with this complaint. Even after accepting the notice issued from this Commission the complainant failed to appear before this Commission today and also failed to take any steps against the opposite party. From the continuous absence and non appearance of the complainant even after accepting the notice from this Commission, we find that the complainant is not interested to further proceed with this complaint.
In the result the complaint is dismissed for default. There will be no order as to cost.
A copy of this order as per the statutory requirements be forwarded to the parties free of charge and thereafter the file be consigned to the record room.
