SRI.P.V.JAYARAJAN: PRESIDENT

This is a complaint filed under section 35 of Consumer Protection Act 2019 and the matter stood over to this date for consideration.After hearing the matter the commission passed an order as follows:

This is a complaint filed by the complainant against the opposite parties alleging deficiency in service on the part of the opposite parties.  After admitting the complaint notice was issued to the opposite parties.  The opposite parties 1 & 2 entered appearance and filed written version denying the allegation raised by the complainant.  When the case came up for consideration on 05/12/2023, both parties submitted that there is a chance of settlement and hence the matter was referred for mediation.  When the case came up for consideration today, both parties were present and submitted that the matter is settled for Rs.18,000/-.  A compromise memo signed by the parties to the proceedings is also filed before this Commission.  As per the terms of compromise, the opposite parties agreed to pay Rs.18,000/- to the complainant within 30 days from the date of this settlement by crediting the aforesaid amount in the bank account of the complainant.   The complainant also agreed that he is got no further claim against the opposite parties.  The compromise memo dated 23/12/2023 is accepted and recorded.  In view of the settlement arrived at between the parties to the proceedings, we find that this is a fit case to be allowed in terms of compromise. 

In the result the complaint is allowed in terms of compromise.  The compromise memo dated 23/12/2023 shall form part of this order.  There will no order as to cost. 

A copy of this order as per the statutory requirements be forwarded to the parties free of charge and thereafter the file be consigned to the record room.
