This is a complaint filed under section 35 of Consumer Protection Act 2019 and the matter stood over to this date for consideration.After hearing the matter the commission passed an order as follows:
This is a complaint filed by the complainant against the opposite parties alleging deficiency in service and unfair trade practice on the part of the opposite parties in connection with the sales and service of a laptop purchased by the complainant from the opposite parties. After admitting the complaint, notice was issued to the opposite parties to appear before this Commission on 20/03/2024. The said notice issued to the 1st opposite party was served on 07/03/2024. The notice issued to the 2nd opposite party was returned with endorsement “addressee cannot be located”. The 1st opposite party entered appearance and filed written version denying the allegation raised by the complainant. As the notice to the 2nd opposite party was returned, the complainant was directed to take steps against the 2nd opposite party. Since 22/04/2024, this case is adjourned for taking steps against 2nd opposite party by the complainant. Inspite of giving sufficient opportunities, the complainant failed to take steps against the 2nd opposite party and hence this Commission adjourned this case to this date for taking steps against the 2nd opposite party and for appearance of the complainant as last chance. When the case came up for consideration today, the complainant was absent and there was no representation. The complainant also not taken any steps against the 2nd opposite party. Since 30/08/2024 the complainant is continuously absent and there was no representation. In view of the above circumstance, we find that the complainant is not interested to further proceed with this complaint. Hence we find that this is a fit case to be dismissed for not taking steps against the 2nd opposite party.
In the result the complaint is dismissed. There will be no order as to cost.
A copy of this order as per the statutory requirements be forwarded to the parties free of charge and thereafter the file be consigned to the record room.
