This application is filed by the appellant for substitution of legal heirs of the respondent who died while process for notice was underway. It is further stated by Mr. A. Mukherjee, learned counsel, appearing for the appellant that as the respondent died unmarried, the only surviving legal heir is his brother, namely Sri Bahar Uddin Barbhuiyan and as such, he prays that Sri Bahar Uddin Barbhuiyan be brought as legal heir of the deceased respondent on record.

            Believing on the statement given by the appellant with the support an affidavit which was duly sworn by the Zonal Manager of UCO Bank, Guwahati, the prayer for substitution is allowed and Sri Bahar Uddin Barbhuiyan shall be impleded as respondent no. 2.

            Accordingly, office shall correct the cause title in terms of the order passed today in this Misc Case.

            M.A. 87/12 stands disposed.
