The petition of complaint u/s 12 of the C.P. Act, 1986 has been filed the complainant Sk. Amirullah against the o.ps. Md. Nasir Ahmed and another. The case of the complainant in short is that complainant entered into an agreement dt.16.1.07 with o.p. no.1 the developer for allotment of a flat as lease hold consideration of Rs.4,50,000/- at premises no.53, Lower Range, P.S. Koreya, Kolkata-19.

We have gone through the agreement dt.16.1.07 executed between the complainant and o.p. no.1 wherefrom we find that there is no whisper of execution of lease, but the agreement clearly speaks of tenancy right which appears to be self-contradictory. That being the position this Forum is not a Civil Court / Tenancy Tribunal. It is surprising to take note that complainant is not actually aware of his case and as such, we are of the view that this case is not maintainable in this Forum and remedy lies elsewhere. Accordingly, the case stands dismissed ex parte with a liberty to agitate this issue before the appropriate Forum.
