Today is fixed for hearing and passing necessary order in respect of this MA/2/2023 that arose from A/10/2022.

It appears from the available materials on record that against the judgement passed by the Ld. DCDRC Birbhum (Suri) in connection with CC/105/2017 in which the appellant of A/10/2022 i.e. the present applicant were the Ops on 09.10.2023 present applicant/appellant, the applicant/appellant have preferred Appeal A/10/2022 before this Commission and vide IA/72/2022 they had sought for condonation of delay in filing the Appeal and that IA was dismissed on contest making the Appeal A/10/2022 otiose and at this point of time the appellant/applicants of A/10/2022 and IA/72/2022 (Excide Industries Limited) has prayed for returning the deposited amount of Rs 76,063/- that was deposited by the appellant/applicant for the purpose of the Appeal.

Since, it is pressed from the end of the appellant/applicant that they are intending to comply the award amount.

It is considered and allowed.

Applicants of MA/2/2023 at liberty to withdraw the said amount submitted from their end before this Commission for the purpose of this Appeal preferred by them vide A/10/2022.

Office is to direct to do the needful accordingly in view of this order.

Hence, the MA/2/2023 is thus disposed off.
