ORDER

The record is put up at the instant of the complainant.

The interim petition filed by the complainant is to be disposed of.

Considering urgency the record is taken up for admission hearing. Perused the complaint and documents. Heard. We find prima facie case. Issue summons.

The application dt. 04.01.2018 filed by the complainant Sukhjinder Singh against the O.Ps WBSEDCL for passing interim order U/s 13(3B) of C.P. Act, 1986 is taken up for hearing treating the same as M.A case No. 3/2018.

Perused the complaint, interim application and documents. Heard Ld. Advocate/Agent of the complainant.

We find that it is the case of the complainant that he is enjoying electricity in his premises being consumer ID No. 500579347 and has been paying bills regularly but by serving a notice dated 22.11.2017the O.Ps informed that outstanding amount of Rs. 51799/-  due in connection with consumer ID No. 522076973 and directed to pay the same within 7 days from the receipt of the letter failing which the connection will be disconnected.

It is further case of the complainant that he is not consume in relation to consumer ID No. 522076973 and he is not liable to pay dues of other consumer and ultimately pray/ed for passing interim order directing the O.Ps not to disconnect his connection No. 500579347.

We find that the bill and receipt show that the complainant is consumer in connection with consumer Id No. 500579347 and he has paid bills upto December 2017.

So, certainly the complainant is not liable to pay outstanding bills of other consumer ID No. 522076973 of the same premises of the complainant.

We find that balance of convenience and inconvenience is also in favour of the complaint and he will be much prejudiced if his electric connection is disconnected.

In view of the facts and circumstance stated above and materials on record, the petition dated 04.01.17 filed by the complainant for passing interim order is allowed.

The O.P Md. Bazar CCC, WBSEDCL, P.S. Md. Bazar, Dist. Birbhum is hereby restrain to disconnect the electric line of the complainant i.e. consumer ID No. 500579347 till 11.01.2018.

Thus the M.A No. 3/2018 is disposed accordingly.

Let a copy of the order is supplied to the complainant at free of cost and another copy be sent to the O.Ps for compliance by registered post.
