Final Order / Judgement

        On 12-5-2016, this Commission passed the following order;-

            “Heard Mr. A. Mukharjee, learned counsel, appearing for the appellant. None appeared for the respondent. After hearing some time, we have found that at paragraph 11 of the written statement filed by the bank authority mention has been made about the terms and conditions with regard to payment of loan amount by the bank to the beneficiaries. However, copy of the terms and conditions are not available in the record. Mr. Mukhajree is therefore directed to file a copy of the same.

            Mr. Mukharjee has prayed for four weeks time to collect the same.

            Prayer is allowed.

            List it on 2-8-2016”.

                  However, thereafter whenever the matter came up before this Commission, either time was sought for on behalf of the appellant or there was no representation on behalf of the appellant. Today also when the matter was called on, none appeared for the appellant nor the respondent.

                  On 11-5-2018, this Commission passed the following order;-

                  “None appeared for the parties.

                  For the ends of justice, list it again for hearing on 28-8-2018.”

                  Today also, when the matter was called on, none appeared for the appellant.

                  In view of the above, the appeal is dismissed for non-prosecution.

                  Statutory amount deposited by the appellant at the time of fling the appeal, shall be returned to the appellant or their authorised agent.        

                  Send back the original record along with a copy of this order to the District Forum.
