Mr. S. Sharma, learned counsel, for the appellant is absent. It is seen from the records that Mr. Sarma sought time in order to file the written argument on 05-02-2024. Again on 29-02-2024, the counsel for the appellant was absent. Similarly, on 22-03-2024 the counsel for the respondent No 1 entered appearance and filed the written argument but the counsel for the appellant was absent. On 09-05-2024, none for the parties were present considering that the matter is pending since the year 2017, we presume that the appellant is not interested in proceeding in this appeal, hence same stands dismissed for default.
