  1. The instant case was filed by complainant U/S 12 of the C.P. Act, 1986 wherein the complainant has prayed for direction upon the o.ps. to complete the remaining 200 sq. ft. area out of 300 sq. ft. at the 1^st floor of the premises at 27/8, A.K. Roy Chowdhury Lane, P.S. Shibpur, Howrah, or to pay compensation to the tune of Rs. 5 lakhs together with litigation costs.

  2. In spite of proper service of notice, the o.p. did not turn up, nor did file written version.

3.        Upon pleadings of both parties two points arose for determination :

i)          Is there any deficiency in service on the part of the O.Ps.  ?

2. Whether the complainant is entitled to get any relief as prayed for ?

DECISION  WITH   REASONS      :

4. Both the points are taken up together for consideration. On scrutiny of the enclosures it appears that the o.p. has been demanding huge extra amount for 300 sq. ft. flat ( B- Schedule ) though he received Rs. 2,40,000/- as the total consideration money.

           In such circumstances, we are of the view that the prayer of the complainant for refund of the money shall be allowed. Both the points are accordingly disposed of.        

      Hence,

O     R     D      E      R      E        D

      That the C. C. Case No. 354 of 2014 ( HDF 354 of 2014 )  be  and the same is allowed ex parte  with  costs as  against  the O.Ps. 

      The O.Ps. jointly and severally  be directed to refund the sum of Rs. 2,40,000/- to the complainant together with interest at the rate of 10% per annum from 28.03.2011 till full satisfaction   within 30 days from the date of this order. The complainant be directed to deliver khas possession of the existing 100 sq. ft. flat already in his possession.

      The O.Ps. jointly and severally  do further pay a sum of Rs. 2 lakhs as compensation to the complainant for causing mental pan and utter frustration within the period as mentioned above failing the sum of Rs. 2 lakh shall carry interest at the rate of Rs. 12%  p.a. till full satisfaction.

      The complainant is at liberty to put the decree into execution after expiry of the appeal period.

      Supply the copies of the order to the parties, as per rule.
