File taken up today as the complainant and opposite party No. 1 moved an application for preponement of the case. Learned counsel for the opposite party No. 1 made a statement that the opposite party No. 1 is ready to compromised the matter with the complainant, as per compromise opposite party No. 1 is ready to pay the entire amount of Rs. 10,00,000/- (Ten Lacs Only). The opposite party No. 1 is also ready to pay future benefits of policy No. 6403031137 i.e. 10% of sum assured for every year till ten years as full and final settlement of the claim. His statement recorded and taken up on the file. 

On the other hand the complainant made a statement that I have heard the statement of learned counsel for the opposite party No. 1 and I agree with the same. Today I have received the cheque of Rs. 10,00,000/- (Ten Lacs Only) bearing No. 990484 dated 8.11.2023 of Axis Bank. I undertake to indemnify the better claimant if comes in the future. I will receive the future benefits of the policy in my bank Account No. 920010060647614 of Axis Bank. So, in view of the above statement I withdraw the present complaint. Her statement also recorded and taken up on the file.

In view of the statements of the parties, present complaint is dismissed as withdrawn. However, the parties are bound by their Sinderpal Kaur Vs Max Life Insurance Co. Limited CC 229/2022
