Meenakshi Shahi Vs. MAX Bupa Health Insurance Co. Ltd. & Others.

 

Present: Sh. Amit Beri, Adv along with Complainant Meenakshi Shahi.

 

Sh. Gautam Kumar, Adv Counsel for OP No.1 & 2.

OP No.3 exparte.

 

Today, case is fixed for evidence of the OP No.1 and 2, subject to cost of Rs.200/-, which is to be deposited in the Legal Aid Fund.

Today, counsel for the OP No.1 and 2 suffered a statement that he has settled the matter with the complainant and ready to pay Rs.4,05,000/-, for that OP needs four week time to make the payment and similarly, the complainant along with her counsel Sh. Amit Beri, Adv suffered a statement that she is ready to accept the amount of Rs.4,05,000/- as full and final settlement and undertake to withdraw the complaint on the receipt of the above said amount.

After recording their respective statement, the counsel for the OP No.1 and 2 failed to pay the cost of Rs.200/-, imposed on the previous date, which is mandatory to deposit for further proceeding, so, accordingly OP No.1 and 2 are directed to deposit the aforesaid amount with the District Legal Aid Fund, Jalandhar, failing which the offer of OP No.1 and 2 will not be considered as accepted.

In view of the above condition, the complaint of the complainant is partly accepted and in view of the compromise between the parties and OP No.1 and 2 are directed to pay the settled amount of Rs.4,05,000/- to the complainant on or before 12.01.2019, failing which the OP No.1 and 2 will pay interest thereon @ 12% per annum from the date of filing complaint, till realization and further OP No.1 and 2 are also bound to deposit the cost of Rs.200/- in the Legal Aid Fund and accordingly, this complaint is disposed of. Copies of the order be sent to the parties free of costs under the rules. File be consigned to the record room.
