This case record is taken up for consideration for passing order in respect of the petition filed by the applicant  who is the OP of CC Case No. 21/2023 on the ground  that the CC Case No. 21/2023  is not maintainable in the eye of law.

This   matter has been contested  by the OP of this MA Case who is the complainant  of CC Case No. 21/2023.

Heard and considered submissions.

Perused   the petition filed on the ground of maintainability  and also examined the written objection  filed by the OP of the MA Case.

After going through the materials  of this case record and also after  making scrutiny of the materials of CC Case No. 21/2023, this District Commission finds that the CC Case No. 21/2023 is pending at this stage of evidence and so this case on the verge of disposal.  In view of this position it would be just and proper to hear the maintainability matter alongwith  trial of this CC Case.

So let the petition  filed by the OP of the CC Case on the ground of maintainability of the CC Case be heard alongwith the trial  of the CC Case.

In the light of the observation made above  this MA Case is disposed of .

Let the case record of MA Case No. 90/2023 be tagged with the case record of CC Case No. 21/2023.
