Present complaint case has been filed by the complainant Avneet Kaur against Master's Institute of Fashion Design and others for deficiency on the part of the opposite parties regarding educational matter regarding issue a rectified and correct statements of marks of which subjects the complainant has appeared and to issue immediately degree of MBA of the subject which was opted by the complainant at the time of taking the admission.

In view of the law laid down by the Hon'ble Supreme Court of India in case P.T.Koshy & Anr. Versus Ellen Charitable Trust & Ors. 2012(3) CPC 615 that education is not a commodity. Educational institutes are not providing any kind of service, therefore, in the matter of admission, fees etc., there cannot be a question of deficiency of service. Such matters cannot be entertained by the Consumer Forums under the Consumer Protection Act.1986. So, this Forum has no jurisdiction to try and decide the present case. However, complainant shall be at liberty to file her case before the appropriate court having jurisdiction. Copies of the order be furnished to the parties free of costs. File is ordered to be consigned to the record room.
