This is a case against Masiur Rahaman, S/o Late Bayatulla Dafadar the owner of Rani Brick Field, Chapra, Nadia filed by Ranjit Biswas, S/o Rasik Lal Biswas.  The facts of this case are as under:-

 Ranjit Biswas paid Rs. 54,000/- for purchasing 12000 bricks from the OP.  The money was received by the OP as per the receipt filed before this Forum, but the bricks were not supplied. 

Hence, the complainant had to knock at the door of the Forum on 19.02.15 by filing a complaint. 

The complainant has filed himself an affidavit in support of his claim and appears as PW – 1.

The unchallenged testimony of the complainant has proved the case of the complainant that he paid Rs. 54,000/- to the OP, Masiur Rahaman, but he neither paid back the money nor supplied the bricks.  Hence, the complainant is entitled to get a decree of Rs. 54,000/- and he is also entitled to get interest @ Rs. 5% per month upon the amount from the date of filing the case till the date of realization.    The complainant is also entitled to get Rs. 500/- by way of compensation for his harassment.

That the case, CC/2015/20 be and the same is decreed ex parte.  The OP, Masiur Rahaman is directed to pay Rs. 54,000/- plus interest @ Rs. 5% per month upon the amount from the date of filing the case till the date of realization along with Rs. 500/- as compensation to the complainant within 12.08.2015.
