            During the course of hearing on the last date of hearing on 02.02.2022, a specific query was put to  counsel for the complainant as to where is the subject vehicle,  to which counsel for the complainant  submitted that to the best of his knowledge, the vehicle has been disposed off

                                                                                                               

 to a third party.  He sought time to seek instructions from the complainant on this aspect.  Thereafter the complainant has not appeared before us till date nor any information as to the status of the vehicle has been filed on record.  

Since the  complainant has not been appearing in this  case, the statement of counsel for the complainant made on the last date of hearing is presumed to be true. In view of the above revelation/admission on the part of the complainant, no cause of action survives in the complaint. We may  here refer to the  judgment   of the Hon’ble National Consumer Disputes Redressal Commission in the case of M/S. Honda Cars India Ltd. vs Jatinder Singh Madan, (Revision Petition NO.2622/2012, decided on 11 October, 2013) wherein  it was held that since the complainant has sold the vehicle, the complaint is rendered infructuous as the complainant is no more a consumer. 

In view of the aforementioned ruling, the complaint is dismissed as infructuous. File be consigned to record room.
