This appeal has been referred to me u/s 16 (1B) (iii) of the C.P.Act,1986 in which both the members of Bench No.3 have written their separate orders.

I have heard both the counsels and have perused the judgment passed by Bench No. 3. I find that though both the members have written separate judgments but this is not a judgment of dissent. Mr. Anil Kumar Mishra, Prisiding Member dismissed the appeal on the ground that no manufacturing defect has been found in the car. Hence, the complaint was rightly rejected by the learned DCF. Similarly the other Member Mr.Liyakat Ali also dismissed the complaint on the same ground concluding that the vehicle had run over 42000 km. and no manufacturing defect was proved.

 

In view of this I find no disagreement in two separate judgments of the learned members. Hence, the appeal was rightly dismissed by both the members.
